Freedom of Information (FOI)


The Freedom of Information Act provides the following statutory rights:

  • the right to access records held by public bodies covered by the Act
  • the right to have personal information in a record amended where such information is incomplete, incorrect or misleading
  • the right to obtain reasons for decisions taken by public bodies affecting the person.

The Act distinguishes between personal and non-personal information.  You can access your personal information regardless of when it was created if it is still in existence. You can only access non-personal information/records created on or after 21 April, 2008.

When you make a request you must:

  • Submit the request in writing
    Specify that the request is being made under the FOI Act. Be clear so that the records requested can be identified.  This can be achieved by specifying which school, centre or department of LMETB the records would most likely be located, for example, Human Resources department.  However, if it is unclear what records are being requested, LMETB assist the requester to put his/her request in such a way that the records being sought can be identified.
  • When you are seeking information which is personal, you will be required to supply the appropriate identification as required by the decision maker.
  • In cases where you are seeking to access records relating to a deceased person under section 37(8), you will be required to provide additional details in order to exercise these rights.
